Harassment cease and desist: you told them to stop. Now a lawyer is.

Repeated unwanted calls, texts, emails, visits, or messages to your employer or family are exactly what this letter names, dates, and puts on law-firm letterhead. This letter states exactly what must stop, that all further contact is unwelcome, and what happens if it continues.

Short answer

A harassment cease and desist letter is a private written demand that a known person stop calling, texting, emailing, visiting or contacting your employer or family, and it fixes the date they were told the contact is unwelcome. It is not a court order: New York has no civil lawsuit for harassment as such, and an order of protection comes only from Family Court, Criminal Court or Supreme Court. If there are threats, stalking or violence, call 911 and ask about an order of protection instead.

For a known person whose address or email you have. Threats of violence, stalking, or domestic situations are routed to emergency and order-of-protection guidance at intake rather than a letter, as the terms describe. Background reading from the firm: harassment cease and desist letters in New York.

Notice is what changes the legal picture

A written demand makes it hard for anyone to claim later that the contact was welcome. A signed attorney letter, delivered by mail and email, fixes that date and becomes the first exhibit if you ever need a court.

What this letter is, and is not

It is a private demand, not a court order. If you are in danger or the conduct involves threats, stalking, or violence, call 911 and ask about an order of protection: Family Court for a relative, spouse, ex-partner or co-parent, criminal court for anyone else once charges are brought; the intake screens for that first and tells you plainly.

Civil remedies sit behind it

Depending on the conduct, New York recognizes civil claims for trespass and private nuisance where the conduct involves your property; emotional-distress claims exist but rarely succeed, and there is no civil lawsuit for harassment as such. Harassment itself is an offense under the Penal Law. The letter identifies the conduct in those terms without overstating anything.

No counter-threats, no leverage games

The letter never threatens a criminal complaint or a licensing report as a bargaining chip; that is improper and it weakens you. It demands cessation and preserves your options.

Questions before you start

Will a letter make them angrier?

It can. A calm, specific attorney letter creates a dated record and raises the cost of continuing. No outcome is guaranteed, and if anything in the contact feels threatening, the intake points you to an order of protection instead.

Can I get an order of protection from this?

No. Orders of protection come from Family Court, Criminal Court, or Supreme Court. If your situation calls for one, the intake says so and points you there; the letter is for conduct that is intrusive and persistent but not dangerous.

The person is a neighbor. Does that change anything?

Neighbor matters often add trespass and nuisance elements and sometimes a co-op board or management company that should receive a copy. The intake asks, and the letter is drafted accordingly.

What if they keep going after the letter?

You will have a dated demand, proof of delivery, and their continued conduct in writing, which is exactly what a court or the police want to see. The response memo after your window closes maps the next step.
